Weekly Overtime


In the United States, Federal Law dictates that any hours worked OVER 40 in a given work week must be paid at 1 1/2 times the employee's regular rate.  
Acosta Group work week is defined as SUNDAY thru SATURDAY.




Daily Overtime

In addition, these Specific States have laws related to DAILY Overtime that go above any beyond the Federal mandate:


  1. ALASKA...................After 8 hours worked, all additional hours for the day paid at 1½ times their regular rate
  2. CALIFORNIA............After 8 hours worked, all additional hours for the day paid at 1½ times their regular rate; After 12 hours worked, all additional hours for the day paid at 2 times their regular rate.
  3. COLORADO.............After 12 hours worked, all additional hours for the day paid at 1½ times their regular rate
  4. NEVADA...................After 8 hours worked, all additional hours for the day paid at 1½ times their regular rate
  5. PUERTO RICO.........After 8 hours worked, all additional hours for the day paid at 1½ times their regular rate
  6. VIRGIN ISLANDS.....After 8 hours worked, all additional hours for the day paid at 1½ times their regular rate



Additional Special Overtime Calculations


Here are the special rules that apply Overtime in non-traditional scenarios.  These are calculated in addition to the standard Overtime and Doubletime rules for the state.

 

Rhode Island

Rhode Island requires employers to pay employees 1½ times their regular rate on the following special dates:


  1. Sunday - every Sunday is paid at 1½ times their regular rate
  2. New Year's Day
  3. Memorial Day
  4. Independence Day
  5. Victory Day -- This is the 2nd MONDAY in August
  6. Labor Day
  7. Columbus Day
  8. Veterans' Day
  9. Thanksgiving Day
  10. Christmas Day

California 

In addition to the normal OT rules in CA, they also have a 7th Day Rule:

  1. If an employee works all 7 days within a workweek, then the 7th day must be paid as OT.  They get Regular Overtime for the first 8 hours worked and Double Time for any hours past 8.

Kentucky

Kentucky also has a 7th Day Rule.  


  1. This requires employers to pay employees overtime at the rate of 1½ time their regular rate for all hours worked on the seventh day when an employee works 7 days in a workweek, unless the employee works less than 40 hours during that workweek

Puerto Rico

Puerto Rico also has a 7th Day Rule: 


  1. In order to encourage employers to give a day of rest to employees at least once per week, employees are also entitled by Puerto Rico overtime laws to time and a half overtime pay on their 7th consecutive day of work.

Virgin Islands
Virgin Islands implement a 6th AND 7th Day Rule:

  1. Time and a half is due for all hours worked on the 6th & 7th consecutive days
